Terms of Service

1. Introduction

Welcome to Barnes Branding ("we," "us," "our"), accessible at barnesbranding.shop (the "Site"). These Terms of Service (the "Terms") govern your access to and use of the Site and your purchase of products from us. By placing an order, browsing, or otherwise using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site or place an order.

We reserve the right to update or modify these Terms at any time. Changes take effect immediately upon posting to the Site. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

Our Refund Policy, which governs returns, exchanges, and refunds, is maintained as a separate document and is incorporated into these Terms by reference.

2. Eligibility & Accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order on the Site. If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at info@barnesbranding.com if you suspect unauthorized use of your account.

3. Products & Order Acceptance

We offer a mix of ready-to-ship, in-stock merchandise and made-to-order / custom-printed products (including team, school, and organization apparel). Product listings will indicate, where applicable, whether an item is made-to-order.

All orders are subject to acceptance and availability. We reserve the right to refuse, cancel, or limit any order for any reason, including but not limited to: suspected fraud, pricing or listing errors, unavailability of inventory or materials, or issues with a submitted design, logo, or artwork. If we cancel an order after payment has been processed, you will receive a full refund of amounts paid for that order.

Product colors, sizing, and print placement may vary slightly from images shown on the Site due to monitor display settings, garment dye lots, and manufacturing tolerances typical of the apparel decoration industry.

4. Made-to-Order & Custom Products

Many of our products are printed, embroidered, or otherwise produced specifically for your order after it is placed. By ordering a made-to-order or custom item, you acknowledge and agree that:

●       Production begins shortly after order confirmation, and lead times may be longer than for in-stock items.

●       You are responsible for reviewing and approving names, numbers, sizing, colors, and any custom text or artwork before completing your order. Once production has started, changes cannot be guaranteed.

●       Custom and made-to-order items are subject to the terms of our separate Refund Policy.

5. Pricing & Payment

All prices are listed in U.S. Dollars (USD) and are subject to change without notice. Applicable sales tax and shipping charges will be calculated and displayed at checkout. Payment is due in full at the time of order.

We use Shopify's secure checkout to process payments. We do not store your full payment card details.

6. Order Cancellations

Because made-to-order items enter production quickly, cancellation requests must be submitted as soon as possible after purchase by contacting info@barnesbranding.com. We cannot guarantee that a cancellation request will be honored once production has begun. In-stock items may generally be cancelled prior to shipment.

7. Shipping & Delivery

Estimated production and shipping times will be noted on product pages or at checkout where available. Made-to-order items typically require additional production time before shipment. We are not responsible for delays caused by shipping carriers, customs, weather, or other events outside our control. Risk of loss and title for products pass to you upon our delivery to the shipping carrier.

8. Returns & Refunds

Returns, exchanges, and refunds are governed by our separate Refund Policy, available on the Site. By placing an order, you agree to the terms of that policy in addition to these Terms.

9. Team Names, Logos & Intellectual Property

Products referencing school, team, or organization names and logos (e.g., "Bellevue East," "Nebraska") are offered for fan and supporter use. All trademarks, logos, and brand names referenced on the Site remain the property of their respective owners. If you are ordering on behalf of an organization, you represent that you have the necessary rights or permissions to request the associated design.

All original content on the Site — including product photography, descriptions, and design layouts created by Barnes Branding — is the property of Barnes Branding and may not be reproduced without permission.

10. User Conduct

When using the Site, you agree not to: submit artwork, names, logos, or text that you do not have the right to use or that infringes on a third party's intellectual property; use the Site for any unlawful purpose; attempt to interfere with the Site's security or normal operation; or submit false or misleading information when placing an order.

11. Limitation of Liability

To the fullest extent permitted by law, Barnes Branding shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Site or purchase of products, including but not limited to lost profits, lost data, or business interruption, even if advised of the possibility of such damages. Our total liability for any claim arising from an order shall not exceed the amount you paid for the product(s) giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless Barnes Branding, its owners, and staff from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of the Site, or content you submit for a custom order that infringes on the rights of a third party.

13. Governing Law

These Terms are governed by the laws of the State of Nebraska, without regard to its conflict of laws principles, and applicable U.S. federal law. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Nebraska, and you consent to the jurisdiction of those courts.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

15. Changes to These Terms

We may revise these Terms from time to time. The "Effective Date" at the top of this page reflects the most recent revision. We encourage you to review this page periodically.
